1. Organizing Company
Promotional actions are promoted by Farmacia Berdaguer CB, hereinafter "Farmacia Berdaguer", domiciled in AVDA Ricardo Soriano no 4 Marbella, Málaga. CIF E 93485308.
2. Scope
Contests and promotions will be extended throughout the national territory.
3. Duration
The start and end dates will be detailed in each of the promotional actions.
4. Participation
In order to participate in the different promotional actions promoted by Berdaguer is required to be a natural person resident in Spain of legal age.
The particular conditions of participation will be specified in each promotion.
As a general rule, and unless otherwise stated in a particular promotion, only one entry per person will be accepted.
5. Winners
The winners of the contests will be for analysis of objective data carried out by Pharmacy Berdaguer.
On the other hand, the winners of the draws will be drawn by computer random selection systems among all those who have participated in accordance with the established rules.
The winners will be informed by email or by posting their name on the Social Networks or Pharmacy website Berdaguer.
For all contests a specific number of winners will be designated, depending on the prizes. In addition, a specific number of alternates will also be chosen using the same selection criteria
If the winner renounces the prize, Pharmacy Berdaguer can decide whether to give it to the alternates or declare it deserted.
In the event that the winner belongs to an area whose tax regime is different (Canary Islands, Ceuta and Melilla) the payment of the corresponding customs tax will be the obligation of that winner.
6. Awards
Each of the prizes awarded will be described in the different promotional actions. If it is an in-kind prize it cannot be redeemed for money.
7. Acceptance of Bases and Responsibility
Participation in each of the promotional actions carried out by Farmacia Berdaguer implies full acceptance of these general bases and the particular conditions that, if applicable, are established in each promotion.
Pharmacy Berdaguer reserves the right to cancel the promotion for justified reasons, as well as modify these bases or those of promotional action at any time or leave the prize deserted. If this happens it will be duly brought to the attention of the participants in the same channel in which the action was carried out, with a reasoned explanation of the decision.
Like the same way, Farmacia Berdaguer reserves the right to exclude those participants who violate the rules established in the bases or whose behavior affects the normal development of the promotional action. As well as disqualifying those who act abusively or fraudulently.
Pharmacy Berdaguer is exempt from liability in the event that it cannot locate the winner for reasons not attributable to the company. The winner also exempts Pharmacy Berdaguer liability for any damages that may arise from the use of the prize awarded.
Any incident that may arise and is not contemplated in these bases will be resolved by pharmacy Berdaguer according to its best criteria.
8. Taxation
In accordance with the provisions of Law 35/2006 of November 28, which approves the Income Tax of Natural Persons, and by Royal Legislative Decree 4/2004, which approves the Consolidated Text of the Law on Corporation Tax, prizes derived from promotional actions are subject to taxation.
It shall be Berdaguer Pharmacy for the realization of the deposit on account or the practice of the relevant withholding. Such withholding or deposit on account will not proceed in prizes less than 300 euros, which are subject to taxation by the Income Tax of Individuals.
Pharmacy Berdaguer not be responsible for the fulfillment of the winner's tax obligations.
In order for the above-mentioned withholdings to be made, the Winner must sign a letter supporting receipt of the prize, provide their tax details and copy of identification document (CIF, VAT number or Resident Card). They must also sign a declaration on the knowledge of the taxation of such prizes.
9. Personal Data
The personal data collected in the promotional actions will be governed by the provisions of the Privacy section of our website.
10. Applicable Law and Jurisdiction
Promotional actions, as well as the bases that regulate them, are subject to Spanish law. Any dispute arising out of them, and in the absence of a friendly agreement, the Spanish courts shall have jurisdiction.
